These Terms of Service (“Terms”) govern your access to and use of Za Poof, a service operated by Big J’s Stuff LLC, 7275 State Fair Blvd, Baldwinsville, NY 13027 (“Company,” “we,” or “us”). Please read these Terms carefully. By accessing or using Za Poof (through web or mobile application), you agree to be bound by them.

1. Scope of Service

Za Poof provides a platform that connects customers who want items removed with independent vendors who provide removal services. Za Poof itself does not remove items; all removal services are performed by independent vendors (“Vendors”).

  • Available via both web and mobile app.
  • The platform enables Customers to request item removal and Vendors to provide quotes and fulfill those requests.

2. User Accounts

  • You must create an account to use Za Poof.
  • You agree to provide accurate and up-to-date information.
  • You are responsible for maintaining the confidentiality of your account login and all activities under your account.

3. Vendor Relationship

  • Vendors are independent contractors, not employees of Big J’s Stuff LLC or Za Poof.
  • Vendors are solely responsible for their own business operations, including insurance, compliance with laws, tools, and transportation.
  • Za Poof does not guarantee the quality, safety, or timeliness of services provided by Vendors.

4. Pricing and Payments

  • Vendors set their own pricing.
  • Payment is made at the time of service, in person, directly to the Vendor.
  • Za Poof does not process payments between Customers and Vendors.

5. Service Expectations

  • Vendors are expected to perform services professionally. They are responsible for damages, missed appointments, or miscommunications.
  • Customers are expected to be professional and punctual in communication and meetings.
  • Either party may be removed from the platform for repeated unprofessional behavior.

6. Cancellations

  • Customers and Vendors are expected to communicate promptly regarding cancellations or rescheduling.
  • Frequent no-shows or cancellations may result in account suspension.

7. Insurance

Vendors are required to maintain their own insurance appropriate to their services. Za Poof does not provide insurance coverage for Customers or Vendors.

8. Privacy

Customer information is only shared with Vendors once the Customer accepts a service offer. Za Poof collects and processes user data in accordance with its Privacy Policy.

9. Disclaimers & Liability

Za Poof is a platform and is not responsible for the actions or omissions of Vendors or Customers. The Company disclaims liability for damages, losses, delays, or disputes arising from services performed by Vendors.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Za Poof shall not be liable for indirect, incidental, or consequential damages.

10. Arbitration Agreement

Any disputes arising from these Terms or your use of Za Poof shall be resolved through binding arbitration, rather than in court, except where prohibited by law.

  • You waive the right to a jury trial or to participate in class actions.
  • Arbitration shall be conducted under the rules of the American Arbitration Association.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for conduct harmful to the platform or its users.

12. Modifications

We may update these Terms from time to time. Continued use of Za Poof after updates means you accept the revised Terms.

13. Governing Law

These Terms shall be governed by and construed under the laws of the State of New York, without regard to its conflict of law principles.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Your information is shared only with a Vendor once you accept their service offer. Vendors only receive the information necessary to perform the service. We may also disclose if required by law.

4. Payments

Payments are handled directly between Customers and Vendors. Za Poof does not process or store payment details.

5. Data Security

We use reasonable security measures to protect your data. No system is completely secure, but we minimize risks.

6. Data Retention

We retain information only as long as necessary. You may request deletion of your account and data.

7. Children’s Privacy

Za Poof is not intended for children under 18. If we learn a child has provided data, we will delete it.
